BEBRE TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (hereinafter – Terms) define the rights and obligations of the buyer and seller of the online store www.bebre.lt, the procedure for purchasing, paying for, delivering, and returning goods, as well as other conditions related to the purchase of goods.

By using the online store and placing an order, the buyer confirms that they have read, understood, and agree to comply with these Terms.


1. GENERAL PROVISIONS

Hereinafter in the document referred to as the Seller.


1.2. Buyer – a natural person who purchases goods in the online store for personal needs.


1.3. These terms are prepared in accordance with:

  • The Civil Code of the Republic of Lithuania;
  • The Law on Consumer Rights Protection of the Republic of Lithuania;
  • Legal acts on electronic commerce of the Republic of Lithuania;
  • Directive 2011/83/EU on consumer rights;
  • General Data Protection Regulation (EU) 2016/679 (GDPR);
  • Other applicable legal acts of the Republic of Lithuania and the European Union.

1.4. The Seller has the right to change these Terms at any time. Their new version comes into force from the date of publication in the online store and applies only to orders placed after their entry into force.


2. CONCLUSION OF THE PURCHASE AGREEMENT

2.1. The purchase-sale agreement is considered concluded from the moment when:

  • the buyer forms a shopping cart;
  • places an order;
  • indicates agreement with these terms;
  • makes the payment.

2.2. The order is considered accepted only after the Seller receives payment confirmation.


2.3. The Seller reserves the right not to confirm an order if:

  • the goods are out of stock;
  • an incorrect price was indicated due to a technical error;
  • payment could not be received;
  • the buyer provided incorrect contact details;
  • there are other objective circumstances preventing the fulfillment of the order.

In such a case, the paid money is refunded using the same payment method used for the payment.


3. BUYER'S RIGHTS

The buyer has the right to:

  • purchase goods in this online store;
  • receive information about goods;
  • withdraw from a distance purchase agreement in accordance with the procedures established by legal acts;
  • return goods according to the Return Policy;
  • contact the Seller regarding warranty or quality issues.

4. BUYER'S OBLIGATIONS

The buyer undertakes to:

  • provide accurate personal data;
  • provide a precise delivery address;
  • pay for ordered goods;
  • accept ordered goods;
  • use goods according to their intended purpose;
  • comply with these terms.

5. SELLER'S RIGHTS

The Seller has the right to:

  • temporarily or permanently suspend the online store's operations;
  • change the assortment of goods;
  • change prices;
  • limit quantities of certain goods per buyer;
  • refuse to fulfill an order due to technical errors or force majeure circumstances.

6. SELLER'S OBLIGATIONS

The Seller undertakes to:

  • enable the use of the online store;
  • provide accurate information about the goods;
  • transfer goods according to the placed order;
  • respect the buyer's privacy;
  • process personal data in accordance with the Privacy Policy and GDPR requirements;
  • inform the buyer about significant order changes.

7. GOODS

7.1. All photos presented in the online store are for informational purposes only.

Due to different screen settings, lighting, or manufacturer's packaging updates, the actual product color, design, or packaging may slightly differ from the photos provided.


7.2. The manufacturer has the right to:

  • change packaging;
  • update the design;
  • change the composition without altering the primary purpose of the product.

Such changes are not considered a product defect.


7.3. The effect of cosmetic products may vary depending on individual skin characteristics, health condition, method of use, and other individual factors.

The Seller does not guarantee an identical result for all buyers.


8. PRICES

8.1. All prices in the online store are indicated in euros (€).


8.2. The Seller has the right to change prices at any time.

Price changes do not affect orders that have already been paid for.


8.3. If an obviously incorrect product price was indicated in the online store due to a technical error, the Seller has the right to cancel the order and refund the money paid to the buyer.

9. PAYMENT PROCEDURE

9.1. The buyer can pay for the goods using the following payment methods:

  • Stripe;
  • Paysera;
  • Visa;
  • Mastercard;
  • Apple Pay;
  • Google Pay.

9.2. Payments are processed using secure third-party payment systems. The Seller does not collect or store the buyer's payment card data.

9.3. The order is initiated only after payment confirmation is received.

9.4. If payment is not received, the Seller has the right to cancel the order.


10. DELIVERY

10.1. Goods are delivered within the territory of the Republic of Lithuania.

10.2. The following partners are used for delivery:

  • LP EXPRESS;
  • DPD;
  • Omniva.

10.3. Delivery terms are provided in the online store and are preliminary.

10.4. Delivery time may be extended due to:

  • a large volume of orders;
  • courier service disruptions;
  • force majeure circumstances;
  • public holidays.

10.5. The buyer must provide a precise delivery address and contact details.

10.6. If the shipment is returned due to an incorrectly provided address or failure to collect from a parcel locker, the repeat shipping costs are covered by the buyer.

10.7. The risk of accidental loss or damage to the goods passes to the buyer from the moment the goods are handed over to the buyer or the recipient specified by them.


11. ORDER CANCELLATION

11.1. As long as the order has not been handed over to the delivery service, the buyer can request its cancellation by email info@bebre.lt.

11.2. If the order has already been handed over to the carrier, cancellation is no longer possible. In such a case, the goods return procedure applies.


12. PRODUCT QUALITY

12.1. The Seller ensures that the sold goods comply with legal requirements.

12.2. The effect of cosmetic products depends on individual skin characteristics, therefore the Seller does not guarantee uniform results for all consumers.

12.3. The buyer, upon receiving a damaged or unsuitable product, must inform the Seller no later than within 14 calendar days from the receipt of the goods.


13. GOODS RETURN

13.1. The buyer has the right to withdraw from a distance purchase-sale agreement in accordance with the procedures established by the legal acts of the Republic of Lithuania.

13.2. Due to hygiene requirements for cosmetic products, only goods that:

  • have not been used;
  • have not been opened;
  • are in their original, undamaged packaging;
  • have not lost their commercial appearance.

13.3. The Seller has the right to refuse to accept returned goods if it is determined that they have been used, opened, or otherwise lost their commercial value.

13.4. Return costs are borne by the buyer, except in cases where defective or incorrectly delivered goods are returned.

13.5. Money is refunded using the same payment method used for the payment, no later than within 14 calendar days from the receipt and evaluation of the returned goods.


14. WARRANTY AND LIABILITY

14.1. The Seller is responsible for non-compliance of goods in accordance with the procedures established by legal acts.

14.2. The Seller is not responsible for damages arising from improper use, storage, or use of the product not in accordance with the manufacturer's recommendations.

14.3. The Seller is not responsible for allergic reactions or individual sensitivity to product ingredients. Before using cosmetic products, it is recommended to familiarize yourself with their composition and, if necessary, perform a sensitivity test.


15. PERSONAL DATA

15.1. The buyer's personal data is processed in accordance with the Privacy Policy and the General Data Protection Regulation (GDPR).

15.2. Buyer data is used only for:

  • order administration;
  • delivery of goods;
  • customer service;
  • fulfillment of legal obligations;
  • marketing only with the buyer's consent or in cases permitted by legal acts.

16. INTELLECTUAL PROPERTY

16.1. All information, texts, logos, design, photos, graphics, and other materials on the online store are the property of the Seller or their rightful owners.

16.2. It is prohibited to copy, distribute, publish, or otherwise use the content of the online store for commercial purposes without the Seller's prior written consent.


17. LIABILITY

17.1. The Buyer is responsible for the accuracy of the data provided.

17.2. The Seller is not responsible for losses incurred due to incorrect data provided by the buyer.

17.3. The Seller is not responsible for disruptions in the operation of the website if they occurred due to third parties, connection providers, servers, or other circumstances beyond the Seller's control.


18. FORCE MAJEURE

18.1. The parties shall not be liable for non-performance of obligations if it arose due to force majeure circumstances.

18.2. Force majeure circumstances include natural disasters, wars, strikes, decisions of state institutions, epidemics, technical disruptions, or other circumstances that could not be foreseen or avoided.


19. DISPUTE RESOLUTION

19.1. All disagreements shall first be resolved through negotiations.

19.2. If an agreement cannot be reached, the buyer has the right to contact the State Consumer Rights Protection Authority (VVTAT).

19.3. A request can be submitted electronically through VVTAT or using the European Commission's online dispute resolution platform, if applicable under current legislation.

19.4. All legal relations are governed by the laws of the Republic of Lithuania.


20. FINAL PROVISIONS

20.1. These rules constitute the entire agreement between the Seller and the Buyer regarding the purchase of goods in the online store.

20.2. If any provision of these rules is found to be invalid, the remaining provisions shall remain in force.

20.3. The Seller has the right to change these rules at any time. The new version comes into effect upon its publication in the online store.

20.4. Issues not covered by these rules shall be governed by the legal acts of the Republic of Lithuania and the European Union.
